  • Procedural Considerations, Entities subject to the FOIA:  The court holds that "[c]ourts are not within the reach of the Freedom of Information Act."  However, "[b]ecause [plaintiff] is proceeding pro se and such motions must be liberally construed, the Court also considers [plaintiff's] request as one made pursuant to the statutes governing criminal cases" even though the court ultimately denies this request.
