  • Procedural Requirements, Entities Subject to the FOIA:  The court affirms the District court's denial of plaintiff's "requests for grand jury transcripts under the Freedom of Information Act."  The court concludes that plaintiff, "failed to make the requisite showing to warrant disclosure," and that "the district court [did not] violate FOIA . . .  by failing to disclose these materials" because it is not an agency subject to FOIA.
