Disposition: Adopting Magistrate Judge's Report and Recommendation; granting defendant's motion for summary judgment

  • Procedural Requirements, Proper FOIA Requests:  The court holds that "[p]laintiff has failed to create a genuine issue of material fact concerning whether he sent a FOIA request."  The court adopts the Magistrate Judge's finding that "[p]laintiff does not even allege that he attempted to submit a FOIA request in one of the three manners provided for on the FBI's FOIPA website."  "Additionally, other than his own conclusory allegations, Plaintiff has failed to provide any evidence . . . establishing that he actually mailed a letter to the Columbia FBI office."
