Mexican National Charged With Illegally Reentering The United States

Tampa, Florida – United States Attorney Roger B. Handberg announces the return of an indictment charging Ever Lopez-Ortiz (40, Mexico) with illegal reentry by a deported alien. If convicted, Lopez-Ortiz faces a maximum penalty of two years in federal prison.

According to the indictment, Lopez-Ortiz was previously deported from the United States on May 24, 2010. Following his previous removal, he did not receive the consent of the Attorney General or the Secretary of Homeland Security to reapply for admission to the United States. On May 12, 2023, Lopez-Ortiz was found to be voluntarily in the United States in the Polk County Jail.

An indictment is merely a formal charge that a defendant has committed one or more violations of federal criminal law, and every defendant is presumed innocent unless, and until, proven guilty.

This case was investigated by U.S. Immigration Customs and Enforcement - Enforcement and Removal Operations. It will be prosecuted by Assistant United States Attorney Adam W. McCall.
