February 1, 2012, Chief U.S. District Judge Sharon Lovelace Blackburn sentenced Chelsea Catherine Stewart to a total of 39 months in federal prison.  Stewart must serve 15 months for Wrongfully Obtaining Individually Identifiable Health Information and Attempted Bank Fraud.  After that, she must serve 24 more months for Aggravated Identity Theft for her use of another person’s information during the Attempted Bank Fraud.

Unless Stewart files an appeal, which is not expected, this site will not be updated again.



January 22, 2012

January 17, 2012, US Magistrate Judge T. Michael Putnam revoked Chelsea Catherine Stewart’s bond and ordered that she remain in jail until she is sentenced.

Chelsea Catherine Stewart will be sentenced by Chief Judge Sharon Lovelace Blackburn on February 1, 2012 at 10:30 a.m.  The hearing will be held in Courtroom 8 of the Hugo Black US Courthouse, located at 1729 5th Avenue North, Birmingham, Alabama  35203.

All victims can attend this hearing and can let the Court know how Ms. Stewart’s crimes have impacted them.  If you wish to relay such information to the Court (even if you can’t come to the hearing), please contact prosecutor Melissa Atwood at (205) 244-2001 no later than January 31, 2012.  Ms. Atwood will talk with you about the best method for your information to be provided to the Court.

December 2, 2011

On November 28, 2011, US District Judge Sharon Blackburn accepted Chelsea Catherine Stewart’s guilty plea to three of the crimes with which she had been charged.  As part of a plea agreement with the Government, the other three charges will be dismissed.

Ms. Stewart’s sentencing hearing likely will take place in the Spring of 2012.  No formal date for that hearing has been set.

U.S. v Chelsea Catherine Stewart Information

November 1, 2011, US Magistrate Judge Robert Armstrong ruled that Chelsea Catherine Stewart is competent to face the indictment against her.  This ruling clears the way for Ms. Stewart to go to trial or enter a guilty plea.

If Ms. Stewart pleads guilty, she likely will do so during the month of November.  If she proceeds to trial, that trial likely will occur in December 2011.  No formal date for either proceeding has been set.

Defendant Chelsea Catherine Stewart was arraigned by US Magistrate Judge Robert R. Armstrong, Jr., on Thursday, July 14, 2011, at 9:30 AM, at the HUGO L. BLACK U.S. COURTHOUSE, 1729 5th Avenue North, Birmingham, Alabama, 35203.

At this arraignment hearing, the Judge formally notified Defendant Stewart of the charges against her and allowed her to enter a plea of “not guilty.”

No further court dates have been set.  This site will be updated when a new court date is set.
