Cherry Creek Man Sentenced for Sexual Abuse of a Person Incapable of Consent

United States Attorney Ron Parsons announced that a Cherry Creek, South Dakota, man convicted of Sexual Abuse of a Person Incapable of Consent was sentenced on April 20, 2020, by Chief Judge Roberto A. Lange, U.S. District Court.

Angelo Ashley, age 21, was sentenced to 144 months in federal prison, followed by 5 years of supervised release, and a special assessment to the Federal Crime Victims Fund in the amount of $100.

Ashley was indicted by a federal grand jury on September 11, 2018.  He pled guilty on January 28, 2020.

The conviction stemmed from an incident that occurred on or about March 26, 2016, at Cherry Creek. Ashley knowingly engaged in a sexual act with a minor female, who was physically incapable of declining participation in and communicating an unwillingness to engage in the sexual act.  

This case was investigated by the Federal Bureau of Investigation and the Cheyenne River Sioux Tribe Law Enforcement Services.  Assistant U.S. Attorney Cameron J. Cook prosecuted the case.

Ashley was immediately remanded to the custody of the U.S. Marshals Service.
