The Durbin Podcast is a periodic audio presentation addressing relevant legal and other issues prepared and hosted by Richard Durbin, Senior Litigation Counsel for the Western District of Texas. Please listen in as Richard discusses new or recurring issues in ways that might refresh your memory, challenge your current understanding, and broaden your knowledge of them.

Episode 1: Bail and Pretrial Detention

The first podcast, Richard discussed bail and pretrial detention with U.S. Magistrate Judge Henry Bemporad and San Antonio Police Department Captain David Scepanski.

Episode 2: Rule 404(b), Fed. R. Evid.

In this second podcast Richard focuses on Federal Rule of Evidence 404(b), with comments and insight from guest Joe Gay, Appellate Chief.

Episode 3: Cartel War (Part #1)

In this two-part episode of the Podcast Richard discusses the history of the Mexican drug cartels, the bloody cartel war in Juarez, and the prosecution arising from the murder of three U.S. citizens connected to the U.S. Consulate. The podcast explores the testimony and role of an assassin for the Juarez Cartel, and includes insightful background and comments from San Antonio Division Chief John Gibson, a member of the trial team.

In this three-part episode of the Durbin Podcast, Richard considers the don’t’s and do’s of Closing Argument in criminal cases. An area of litigation practice that has been fraught for prosecutors, Part One addresses a number of arguments the courts have found to be improper or highly disfavored. Alpine Chief Jay Miller reenacted a number of those arguments for the podcast. In Parts Two and Three, Richard interviews AUSA Jim Blankinship at length, who provides a thoughtful, insightful, and comprehensive approach to closing argument that allows for highly effective closing argument while avoiding the dangers described in Part One.
