Victim Notification - United States v. Timothy Darrell Penick

Case Description

On May 5, 2021, Timothy D. Penick of Lighthouse Properties of Virginia pled guilty to a Criminal Information in the United States District Court for the Western District of Virginia, pursuant to a Plea Agreement.  A Criminal Information is a document filed in federal court charging a person with a crime.  

Between approximately 2011 and 2020, Penick owned and operated Lighthouse Properties in Campbell County. Lighthouse Properties was a real estate management company providing services to property owners, renters, homeowners associations, and home buyers/sellers. Beginning around June 2018, Penick devised a scheme to defraud multiple clients of Lighthouse Properties. As part of the scheme, Penick obtained authorization from clients to directly access their bank accounts.  Penick then transferred funds from those client bank accounts to other bank accounts in Lighthouse Properties’ name. Penick then used this money for improper purposes. To conceal the misuse of client funds, Mr. Penick provided those clients with fraudulent bank account statements that omitted these transactions and reflected much higher account balances. The Criminal Information charged Penick with a single count of wire fraud in connection with this scheme.

Penick is currently released on bond.

Pursuant to the plea agreement in this case, the Court will order restitution in an amount to be determined by the Court at his sentencing. In advance of sentencing, the United States Probation Office will evaluate all claims for restitution and, ultimately, make a recommendation to the Court. If you believe that you have suffered financial losses as a result of Mr. Penick’s criminal conduct and would like to be considered for restitution, please submit information regarding your claim to Kimberly Sanders-Johnson at kimberly.sanders@usdoj.gov.
