Bill Mercer, United States Attorney for the District of Montana, announced today that during a federal court session in Great Falls, on January 15, 2009, before U.S. District Judge Sam E. Haddon, JUSTIN DALE TENDOY, a 23-year-old resident of Havre, appeared for sentencing. TENDOY was sentenced to a term of:

• Probation: 3 years

• Special Assessment: $100

TENDOY was sentenced in connection with his guilty plea to making false statements during a firearms transaction.

In an Offer of Proof filed by the United States, the government stated it would have proved at trial the following:

On February 28, 2008, and again on March 6, 2008, TENDOY made false statements during a firearms transaction in order to obtain a Savage .300 SW rifle from a licensed federal firearms dealer. At the time, TENDOY was under information in a four-count information in Hill County for felony distribution of dangerous drugs.

Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that TENDOY will likely serve all of the time imposed by the court. In the federal system, TENDOY does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.

Assistant U.S. Attorney Paulette L. Stewart prosecuted the case for the United States.

The investigation was a cooperative effort between the Tri-Agency Safe Trails Task Force and the Rocky Boy's Police Department.
