Robert Bolan Sentenced in U.S. District Court

The United States Attorney's Office announced that during a federal court session in Great Falls, on March 31, 2011, before U.S. District Judge Sam E. Haddon, ROBERT BOLAN, a 48-year-old resident of Havre, appeared for sentencing. BOLAN was sentenced to a term of:

Prison: 63 months

Special Assessment: $100

Supervised Release: 10 years

BOLAN was sentenced in connection with his guilty plea to viewing child pornography.

In an Offer of Proof filed by Assistant U.S. Attorney Cyndee L. Peterson, the government stated it would have proved at trial the following:

BOLAN was a suspect in a sexual abuse case. In November 2009, BOLAN was interviewed by law enforcement officers and stated that he had child pornography on his computer. He said he obtained them by "surfing" and by searching for "boys links."

A forensic examination of BOLAN's computer found images of child pornography. The last written date range for the images were between December 2006 through March 2009. The examiner also located Internet search terms records indicative of one searching for child pornography such as: very young gay boys; young boys erection galleries; erect young boy; preteen lolita; boys pre teen sex; young boys having sex; nude boys pics; pre teen boy erection; and little boy erection.

Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that BOLAN will likely serve all of the time imposed by the court. In the federal system, BOLAN does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.

The investigation was a cooperative effort between U.S. Homeland Security Investigations, the Havre Police Department and the Bozeman Police Department.
