2 Exemption 3 (Statuory citations Rule 32(c)(3)(E) and 18 U.S.C. 4208(b)(2)) was used in conjunction with the withholding of presentence investigation reports up until May 16, 1988. In light of the Supreme Court decision in U.S. Department of Justice v. Julian, 108 S. Ct. 1606 (1988), the USPC no longer uses Exemption 3 to withhold presentence investigation reports.
