As a personal injury attorney, I have heard the objections of many who feel that the interim final rule is unfair. I do NOT agree. I think that the plan which has been worked out, while not perfect, is an excellent and fair system. It is easy to understand and for 98% of all people, extremely generous. No system is perfect including the present tort system. I completely endorse the proposed rules.

One comment. I do not understand why anyone would choose track A in lieu of track B. Under A, you can ask for a hearing. Under B you immediately go to a hearing. Since you have NOTHING to lose by having a hearing (they will not reduce the award that you receive under track A), everyone will end up with a hearing anyway. So why not just have a hearing for everyone (just track A or B).
