kongiganak woman indicted by federal grand jury for mail theft
Anchorage, Alaska – A Kongiganak woman was indicted by a federal grand jury in Anchorage for mail theft, announced U.S. Attorney Karen L. Loeffler, District of Alaska.
Agnes Evan, 26, of Kongiganak, Alaska, was arraigned today before United States Magistrate Judge Deborah Smith on the charge of mail theft, contained in a one-count indictment. Ms. Evan pled not guilty to the charge.
According to the indictment, in January 2010, Evan stole registered mail from the Kongiganak Contract Postal Unit in Kongiganak, Alaska.
Assistant U.S. Attorney Yvonne Lamoureux, who presented the case to the grand jury, indicated that the law provides for a maximum total sentence of up to five years in prison, a fine of up to $250,000, or both, and that the government would be seeking restitution in the amount of $10,000. Under the Federal Sentencing Guidelines, the actual sentence imposed will be based upon the seriousness of the offense and the prior criminal history, if any, of the defendant. Magistrate Judge Smith set a trial date of November 1, 2010.
The United States Postal Service Office of Inspector General conducted the investigation leading to the indictment in this case.
An indictment is only a charge and is not evidence of guilt. A defendant is presumed innocent and is entitled to a fair trial at which the government must prove guilt beyond a reasonable doubt.
