Montgomery, Alabama - Allen Caprice Stoudemire, 30, of Midland City, Alabama, wasconvicted at trial on December 13, 2010, in Dothan, of two counts of perjury arising from his testimony in two hearings held regarding criminal offenses with which he had been charged, U.S. Attorney Leura G. Canary announced today. On April 5, 2010, Stoudemire testified under oathduring a change of plea hearing in his case and pled guilty to two offenses. On August 18, 2010, Stoudemire testified under oath during a hearing held on a motion he had filed asking that his guilty plea be withdrawn. At the August 18 hearing, Stoudemire stated that he had lied about each offense during the April 5 hearing. Stoudemire was charged with two counts of knowingly making two or more declarations under oath, which are inconsistent to the degree that one of them is necessarily false.

Stoudemire’s sentencing is scheduled for March 9, 2011, in Montgomery.

The case was investigated by United States Secret Service Special Agent K. Stoudmire and was prosecuted by Assistant United States Attorney W. Brent Woodall.
