Former Montgomery Police Officer Convicted of Wire Fraud and Aggravated Identity Theft

Montgomery, Alabama - On June 29, 2011, Bradley Howard Pemberton, 41, a former police officer with the Montgomery Police Department, was convicted at trial of one count of wire fraud and one count of aggravated identity theft, U. S. Attorney Louis V. Franklin, Sr. announced today.

In reference to Count One, the evidence introduced at trial showed that, on December 2, 2008, Pemberton, for the purpose of executing a scheme and artifice to defraud outlined in the indictment and for obtaining money and property by means of materially false and fraudulent pretenses, representations, and promises, did transmit and cause to be transmitted in interstate commerce, by means of a wire communication, certain signs, signals, and sounds, that is an application for a Discover Card credit card application, that was sent via the Internet from Elmore County, Alabama to Ohio, in violation of federal law. The evidence also established that the application Pemberton transmitted contained the name, Social Security number, and date of birth of another individual but listed Pemberton’s address as the mailing address.

In reference to Count Two, the evidence introduced at trial showed that, on December 2, 2008, Pemberton, during and in relation to the charge of wire fraud in Count One of the indictment, did knowingly transfer, possess, and use, without lawful authority, the name, date of birth, and Social Security number of another person, in violation of federal law.

The case was investigated by the United States Secret Service, the Alabama Criminal Justice Information Center, and the Montgomery Police Department and was prosecuted by Assistant United States Attorney W. Brent Woodall.
