Mexican National Sentenced to 46 Months in Federal Prison for Illegally Re-Entering the United States Again
Montgomery, Alabama - Miguel Mendez-Domingo, a citizen and national of Mexico who had been working and living illegally in Houston County, Alabama, was sentenced today by United States District Court Judge Mark E. Fuller to 46-months in federal prison for illegal re-entry into the United States, a felony under federal law, announced George L. Beck, Jr., United States Attorney for the Middle District of Alabama. In January 2012, Mendez pled guilty to being an alien found voluntarily in the Middle District of Alabama without the permission of the Secretary of Homeland Security or the Attorney General of the United States after having been removed from the United States once previously.
Mendez, a native and citizen of Mexico, initially came to the United States illegally in 1998. But after a conviction for Aggravated Indecent Liberties with a Child out of Ford County, Kansas, Immigration and Customs Enforcement (ICE) removed Mendez from the United States in May 2008. Around February 2011, Mendez illegally re-entered the United States and was found about three months later in Houston County following an arrest for Driving under the Influence and Driving without a License.
Having considered Mendez’s personal characteristics and criminal history, as well as Mendez’s illegal return to the United States, Judge Fuller sentenced Mendez to 46-months in federal prison. Mendez also faces administrative removal proceedings with the United States Department of Homeland Security, ICE, following his prison sentence.
According to United States Attorney Beck, “Mendez’s prison sentence demonstrates how important it is to prosecute individuals who illegally return to the United States time and time again and place our community at risk. My office remains committed to prosecuting criminals who repeatedly violate the laws of the United States and seek to destroy the peace and safety of our neighborhoods.”
The case was investigated by agents from the Department of Homeland Security, ICE, Office of Enforcement and Removal Operations. Assistant United States Attorney Monica A. Stump prosecuted the case.
