OAKLAND, Calif. – Sergio Vargas Garibay was sentenced yesterday, to 96 months in prison for possessing more than 50 grams of methamphetamine with intent to distribute announced United States Attorney Melinda Haag and Special Agent in Charge Joseph M. Riehl of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

Garibay, 28, a resident of San Leandro, Calif., pled guilty in open court on July 17, 2012, to one count of possession of more than 50 grams of methamphetamine with intent to deliver it to another person and one count of being a felon in possession of a firearm.

In March 2012, subsequent to an ATF undercover operation, Garibay was arrested at a residence located in Oakland, CA for selling more than five ounces of methamphetamine to an undercover ATF agent. ATF and Oakland Police Department also served a search warrant and seized U.S. Currency and methamphetamine.

“We focus on the implements of the illicit business that make trafficking in illegal drugs a viable and violent threat to public safety,” ATF Special Agent in Charge Joseph M. Riehl said .

The sentence was handed down by United States District Court Judge Claudia Wilken.

The prosecution is the result of an investigation by ATF with the assistance of the Oakland Police Department.
