PALM BEACH COUNTY MAN SENTENCED FOR PREPARING FALSE PERSONAL INCOME TAX RETURNS

Wifredo A. Ferrer, United States Attorney for the Southern District of Florida, and Daniel W. Auer, Special Agent in Charge, Internal Revenue Service (IRS), Criminal Investigation Division, announced that defendant Julio Malqui, of Palm Beach County, Florida, was sentenced today before U.S. District Court Judge Kenneth A. Marra. Defendant Malqui was sentenced to six months of imprisonment, to be followed by one year of supervised release. In addition, Malqui has paid $77,000 in restitution to the IRS and will submit to an IRS audit and pay any taxes and penalties that may be owing for the tax years 2004, 2005, and 2006. Malqui previously pled guilty to a three-count indictment charging him with willfully filing false personal income tax returns with the Internal Revenue Service.

According to court documents and statements, Malqui owned and operated a tax preparation and bookkeeping business known as Malqui Tax, with several locations in Palm Beach County, FL. He charged clients between $80 and $800 for his services. During court proceedings, Malqui admitted to filing false personal tax returns with the IRS that substantially understated his income from the tax preparation business during the years 2004-2006. As revealed in Court during the plea hearing, Malqui avoided approximately $77,000 in personal income taxes through these false returns.

Pursuant to the terms of his Plea Agreement, Malqui has agreed to cooperate fully with the IRS in its civil examination, determination, assessment, and collection of income taxes related to his 2004-2006 income tax returns and further agreed not to conceal or dissipate funds or property that could be used to satisfy such taxes. The defendant also agreed to prepare and file accurate amended individual income tax returns for the years 2004-2006.

Mr. Ferrer commended the investigative efforts of the Internal Revenue Service, Criminal Investigation Division. This case is being prosecuted by Assistant U.S. Attorney Emalyn Webber.
