Todd Clark, 45, from Brandon, Iowa, has been charged with one count of being a felon in possession of a firearm and ammunition as an armed career criminal. The charge is contained in an Indictment filed January 26, 2010, in United States District Court in Cedar Rapids.

The Indictment alleges that, on or about December 17, 2009, Clark possessed a 20 gauge shotgun and ammunition. The Indictment also alleges Clark had three felony convictions for Third Degree Burglary in Benton and Buchanan Counties in 2004 and 2005.

If convicted, Clark faces a mandatory minimum sentence of 15 years’ imprisonment and a possible maximum sentence of life, a $250,000 fine, a $100 special assessment, and 5 years of supervised release following any imprisonment.

Clark appeared on February 2, 2010, in federal court in Cedar Rapids for an arraignment and on February 4, 2010, for a detention hearing. He was held without bond. Clark’s next appearance for trial is set for April 5, 2010.

As with any criminal case, a charge is merely an accusation and a defendant is presumed innocent until and unless proven guilty.

This case is being prosecuted by Assistant United States Attorney Bob Teig as part of Project Safe Neighborhoods, a cooperative local, state, and federal program aimed at the enhanced prosecution of gun crimes. The case was investigated by the Buchanan County Sheriff’s Office.
