sioux city sex offender sentenced for failing to register

A sex offender who moved to Iowa from South Dakota and failed to notify authorities of his new address in Sioux City, Iowa, was sentenced on October 27, 2010, to more than three years in federal prison.

Ricky Wayne Brown, age 55, from Sioux City, received the prison term after a May 24, 2010, guilty plea to the federal charge of failing to register or update his sex offender registration. He previously had been convicted in state court in Plymouth County, Iowa, of felony charges of Lascivious Acts with a Child.

At the guilty plea hearing, Brown admitted he was required to register as a sex offender because of his prior criminal conviction, he moved to Iowa from South Dakota, and he did not register his new address.

Brown was sentenced in Sioux City by United States District Court Judge Mark W. Bennett. Brown was sentenced to 42 months’ imprisonment. The court imposed a longer sentence than the advisory U.S. Sentencing Guidelines range of 18 to 24 months. The longer sentence was based on several factors, including the court’s finding that Brown is a pedophile with a history of molesting young girls. A special assessment of $100 was imposed, and Brown must also serve a 5-year term of supervised release after the prison term. There is no parole in the federal system.

Brown is being held in the United States Marshal’s custody until he can be transported to a federal prison.

The case was prosecuted by Assistant United States Attorney Janet Petersen and investigated by the United States Marshals Service, with assistance from state Sex Offender Registration authorities, the Sioux City Police Department, and the North Sioux City, South Dakota, Police Department.
