baldwin man sentenced to more than five years for possessing a shotgun outside a law enforcement officer's home

A man who illegally possessed a firearm was sentenced yesterday, October 28, 2010, to more than five years in federal prison.

Chad Miller, 33, from Baldwin, Iowa, received the prison term after a May 28, 2010, guilty plea to illegally possessing a gun while he was subject to a state restraining order.

At the guilty plea, Miller admitted he possessed a gun after a state court order restrained him from harassing, stalking, or intimidating an intimate partner. Prior to illegally possessing the gun, Miller threatened a law enforcement officer who arrested Miller for third-offense OWI. Four days after threatening the officer, Miller drove to the officer’s home with an un-cased shotgun and 17 rounds of ammunition in the passenger seat of his car, did a donut in front of the officer’s driveway, and sped away. Miller was arrested a few miles away, where officers discovered the shotgun and ammunition in the front seat of his car. Miller was also charged for fourth-offense OWI. The trial on that charge is pending.

Miller was sentenced in Cedar Rapids by United States District Court Chief Judge Linda R. Reade. Miller was sentenced to 69 months’ imprisonment, and a special assessment of $100 was imposed. He must also serve a three-year term of supervised release after the prison term. There is no parole in the federal system.

Miller is being held in the United States Marshal’s custody until he can be transported to a federal prison.

The case was prosecuted by Assistant United States Attorney C.J. Williams as part of Project Safe Neighborhoods, a cooperative local, state, and federal program aimed at the enhanced prosecution of gun crimes and was investigated by the Bureau of Alcohol, Tobacco, Firearms, and Explosives; Iowa State Patrol; and the Jones County Sheriff’s Office.
