Cedar rapids man charged with being felon wtih two guns adn ammunition

Harold Miller, age 24, from Cedar Rapids, Iowa, has been charged with two counts of being a felon in possession of a firearm and ammunition. The charges are contained in an Indictment filed on February 15, 2011, in United States District Court in Cedar Rapids.

The Indictment alleges that, on or about January 5, 2010, Miller possessed a Glock .40 caliber pistol and 100 rounds of Winchester .40 caliber ammunition. The Indictment also alleges that, on or about January 11, 2011, Miller possessed a Romarm 7.62x39 mm rifle, 340 rounds of 7.62x39 mm ammunition, and 50 rounds of .22 caliber ammunition. According to the Indictment, Miller was previously convicted of the felony crime of Scheme to Defraud 1st Degree in Clinton County, New York, on November 27, 2007.

If convicted on both charges, Miller faces a possible maximum sentence of 20 years’ imprisonment, a $500,000 fine, $200 in special assessments, and 6 years of supervised release following any imprisonment.

Miller appeared today in federal court in Cedar Rapids and was released on bond. Miller’s trial is set for April 25, 2011.

As with any criminal case, a charge is merely an accusation and a defendant is presumed innocent until and unless proven guilty.

This case is being prosecuted by Assistant United States Attorney Bob Teig as part of Project Safe Neighborhoods, a cooperative local, state, and federal program aimed at the enhanced prosecution of gun crimes. The case was investigated by the Bureau of Alcohol, Tobacco, Firearms, and Explosives.
