
Three aliens to prison for illegal re-Entry

Three men who illegally re-entered the United States from Mexico were sentenced to prison on February 22 and 23, 2011, in federal court in Cedar Rapids.
Samuel Martinez-Macias, 29, from Cavillo Aguascalientes, Mexico, received his prison term after pleading guilty to illegal re-entry. Arael Martinez-Perez, 28, from Nogales, Mexico, and Hector Vasquez Gutierrez, 30, from Guanajuato, Mexico, received their prison terms after they pled guilty to illegal re-entry after having an aggravated felony conviction. The men admitted they were illegal aliens present in the United States without permission.
Martinez-Macias had been removed from the United States on October 22, 2000; September 25, 2001; and July 25, 2002. He was arrested by Homeland Security Investigations on August 25, 2010, after agents discovered he was illegally working.
Martinez-Perez had been removed from the United States on November 15, 2001; September 3, 2002; September 6, 2003; April 13, 2007; and April 28, 2010. He was arrested by Homeland Security Investigations most recently on November 3, 2010, following an arrest for operating while intoxicated in Jefferson County, Iowa.
Gutierrez had been removed from the United States on April 3, 2000, and August 12, 2003. He was arrested by Homeland Security Investigations on July 20, 2010, after an arrest for interference with official acts and public intoxication in Scott County, Iowa.
The three men were sentenced in Cedar Rapids by United States District Court Chief Judge Linda R. Reade. Martinez-Macias was sentenced to two years’ imprisonment. He must also serve a one-year term of supervised release after the prison term. Martinez-Perez was sentenced to 30 months’ imprisonment, and Gutierrez was sentenced to 41 months’ imprisonment. Martinez-Perez and Gutierrez must also serve a three-year term of supervised release. All three men are required to pay a special assessment of $100. There is no parole in the federal system. Defendant is subject to removal from the United States after serving his prison term.
The men are being held in the United States Marshal’s custody until they can be transported to a federal prison.
