Two men sentenced on illegal re-Entry charges

Two men who illegally re-entered the United States from Mexico were sentenced on July 5, 2011, to federal prison.

Jose Gileta-Vazquez, age 38, from Mexico, received the prison term after a June 6, 2011, guilty plea to one count of illegal re-entry.

Juan Lopez-Frias, age 37, from Mexico, received the prison term after a June 14, 2011, guilty plea to one count of illegal re-entry.

Gileta-Vazquez was arrested by the Iowa State Patrol for Operating While Intoxicated (OWI) on April 5, 2001, and was transferred to Homeland Security Investigations (HSI) custody. Gileta Vasquez admitted he had been deported from the United States to Mexico on November 12, 1991. Lopez-Frias admitted he was in the United States illegally, having been deported from the United States to Mexico on July 4, 2009. He came into HSI custody after his arrest by the Sioux City, Iowa, Police Department on February 20, 2011, for OWI.

Both men were sentenced in Sioux City by United States District Court Judge Donald E. O’Brien. Gileta-Vazquez was sentenced to 2 months’ imprisonment. Lopez-Frias was sentenced to 6 months’ imprisonment. They both must serve a 1-year term of supervised release after the prison terms. There is no parole in the federal system.

The men are being held in the United States Marshal’s custody until they can be transported to a federal prison.

The cases were prosecuted by Assistant United States Attorney Kevin C. Fletcher and investigated by HSI and Enforcement and Removal Office of the Immigration and Customs Enforcement.
