A man who illegally possessed a handgun was sentenced March 21, 2011, to 12 months’ and one day in federal prison.

Levi Gibbs, III, age 21, of Fort Dodge, Iowa, received the prison term after a September 14, 2010, guilty plea to being a felon in possession of a firearm. Prior to his guilty plea in federal court, Gibbs was convicted of possession of a controlled substance and failure to have a drug tax stamp in Webster County, Iowa, District Court on October 20, 2008.

At the guilty plea, Gibbs admitted that, on February 10, 2009, he possessed a .22 caliber Taurus revolver at his girlfriend’s residence in Fort Dodge. The Iowa DCI Crime Laboratory matched a fingerprint found on the revolver to Gibbs’ fingerprint.

Gibbs was sentenced in Sioux City by United States District Court Judge Mark W. Bennett. Gibbs was sentenced to 12 months’ and one day imprisonment. A special assessment of $100 was imposed. He must also serve a three-year term of supervised release after the prison term. There is no parole in the federal system.

Gibbs is being held in the United States Marshal’s custody until he can be transported to a federal prison.

The case was prosecuted by Assistant United States Attorney Shawn Wehde as part of Project Safe Neighborhoods, a cooperative local, state, and federal program aimed at the enhanced prosecution of gun crimes. The case was investigated by the Bureau of Alcohol, Tobacco, Firearms, and Explosives; Iowa Division of Criminal Investigation; Webster County Sheriff’s Office; and Fort Dodge Police Department.
