Dayton, Iowa, Man Pleads Guilty To Meth Conspiracy

A man who conspired to manufacture methamphetamine pled guilty November 28, 2011, in federal court in Sioux City.

Rex Silvey, 55, from Dayton, Iowa, was convicted of one count of conspiring to manufacture methamphetamine.

At the plea hearing, Silvey admitted that from about December 2009 through July 2011 he conspired to manufacture at least 5 grams of pure methamphetamine. According to pseudoephedrine purchase logs obtained in the investigation, starting in April 2009 Silvey purchased at least 68.99 grams of pseudoephedrine with the purpose of manufacturing methamphetamine. Silvey received methamphetamine in exchange for the pseudoephedrine he provided to others who manufactured the methamphetamine. On March 17, 2011, law enforcement officers executed a search warrant at a residence at which Silvey was also located. Law enforcement seized items consistent with the manufacture of methamphetamine, including pseudoephedrine pills, fertilizer spikes, drain opener, and lithium batteries.

Sentencing before United States District Court Judge Mark W. Bennett will be set after a presentence report is prepared. Silvey was taken into custody by the United States Marshal after the guilty plea and will remain in custody pending sentencing. Silvey faces a mandatory minimum sentence of 5 years’ imprisonment and a possible maximum sentence of 40 years’ imprisonment, a $5,000,000 fine, a special assessment of $100, and four years up to life of supervised release following any imprisonment.

The case is being prosecuted by Assistant United States Attorney Shawn S. Wehde and was investigated by the Webster County Sheriff’s Office, Fort Dodge Police Department, Iowa Division of Narcotics Enforcement, Dayton Police Department, Iowa State Patrol, and the Iowa Division of Criminal Investigations.
