
Guatemalan Man Sentenced To Federal Prison For Illegal Re-Entry

A man who illegally re-entered the United States from Guatemala was sentenced on November 1, 2011, to 13 months in federal prison.
Gabriel Lopez-Chavez, age 34, from Guatemala, received the prison term after an August 23, 2011, guilty plea to one count of illegal re-entry. At the guilty plea,
Lopez-Chavez admitted he was deported from the United States on July 27, 2006. Lopez-Chavez came into Homeland Security Investigations’ (HSI) custody on July 13, 2011, after his arrest in Emmet County for driving without a license.
Lopez-Chavez had previously been convicted in February of 2005, of identity fraud in the State of Utah.
Lopez-Chavez was sentenced in Sioux City by United States District Court Judge Mark W. Bennett. Lopez-Chavez was sentenced to 13 months’ imprisonment. A special assessment of $100 was imposed. He must also serve a 2 year term of supervised release after the prison term. There is no parole in the federal system.
Lopez-Chavez is being held in the United States Marshal’s custody until he can be transported to a federal prison.
The case was prosecuted by Assistant United States Attorney Kevin C. Fletcher and investigated by HSI and the Enforcement and Removal Office of the Immigration and Customs Enforcement Bureau.
