DAVENPORT, IA - On July 19, 2012, James Lavon Miller, age 62, of Kalona, Iowa, was sentenced to 33 months imprisonment for falsely claiming a total of over $6 million in refunds on his tax returns for 2005, 2006, 2007, and 2008, announced United States Attorney Nicholas A. Klinefeldt. United States District Judge John A. Jarvey also sentenced Miller to three years supervised release.

Miller filed five false returns claiming refunds in amounts ranging from approximately $130,000 to over $5 million. Miller supported the claims by listing fabricated interest payments and commensurate amounts of federal withholding in each return. No refunds were actually paid on the claims. Miller has repeatedly refused to comply with IRS requests for information regarding his income and tax liability.

The case was investigated by IRS Criminal Investigation, and was prosecuted by the United States Attorney’s Office for the Southern District of Iowa.
