Utah Man Sentenced for Illegally Possessing Sawed-off Shotgun

POCATELLO – David Duane Geisser, 44, of Sandy, Utah, was sentenced today in federal court to 92 months in prison for possession of an unregistered firearm, U.S. Attorney Wendy J. Olson announced. Chief U.S. District Judge B. Lynn Winmill also ordered Geisser to serve three years of supervised release following his prison term and forfeit the firearm. Geisser pleaded guilty to the charge on February 3, 2012.

According to the plea agreement, on July 12, 2011, Geisser was arrested at a residence in Ammon, Idaho, on a warrant outstanding from the State of Utah. Law enforcement had previously received information that Geisser was in possession of a sawed-off shotgun. In conjunction with his arrest, a search warrant was executed at the residence, where officers discovered a sawed-off Mossberg 12-gauge shotgun in a vehicle. In an interview with law enforcement, Geisser admitted to being in possession of the shotgun. He admitted that he bought the shotgun in Utah, knowing it was illegal to have it. The shotgun was not registered to Geisser in the National Firearms Registration and Transfer Record. According to court records, Geisser is prohibited from possessing firearms due to a 1998 conviction for aggravated robbery in Utah District Court in Salt Lake City, Utah, a felony offense punishable by a term of imprisonment exceeding one year.

The case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), the Bonneville County Sheriff's Office, and the Ogden (Utah) Police Department. It was prosecuted as part of Idaho’s Project Safe Neighborhoods Program, which seeks to reduce gun violence in Idaho.
