FEDERAL GRAND JURY RETURNS INDICTMENTS - MAN CHARGED WITH ARMED BANK ROBBERY OF KU CREDIT UNION

KANSAS CITY, KAN. – Timothy Hays, 21, Lawrence, Kansas, currently in custody, is charged with one count of armed bank robbery of the KU Credit Union, 3400 West 6th Street, Lawrence, Kansas, on July 12, 2010. The indictment alleges that Hays used a loaded handgun to rob the credit union. If convicted he faces a maximum of 25 years for armed bank robbery and a minimum of five years and a maximum of life for using a firearm during the bank robbery. The case was investigated by the Lawrence Police Department and the Federal Bureau of Investigation. Assistant U.S. Attorney Scott Rask is prosecuting.

OTHER INDICTMENTS

The federal grand jury also returned the following indictments:

Scott R. Fonseca, 30, Olathe, Kansas, is charged with possession of eight stolen firearms. If convicted he faces a maximum of ten years in prison. The case was investigated by the Merriam Police Department and Bureau of Alcohol, Tobacco, Firearms and Explosives. Assistant U.S. Attorney Terra Morehead is prosecuting.

Steven McDonald, 31, Leavenworth, Kansas, currently in custody, is charged with willfully escaping from the custody of a half-way house in Leavenworth on August 19, 2009. If convicted McDonald faces a maximum of five years in prison. The case was investigated by the U.S. Marshal’s Service. Assistant U.S. Attorney David Smith is prosecuting.

Chad Green, 37, Kansas City, Kansas, is charged with being a felon in possession of a firearm on July 11, 2010, and seeks forfeiture of the firearm. If convicted Green faces a maximum of ten years in prison. The case was investigated by the Kansas City, Kansas Police Department and Bureau of Alcohol, Tobacco, Firearms and Explosives. Assistant U.S. Attorney Scott Rask is prosecuting.

Gerardo Gonzalez-Lopez, 30, not a citizen of the United States, is charged with illegal re-entry on July 7, 2010, after being convicted of an aggravated felony and deported. If convicted Gonzalez-Lopez faces a maximum of 20 years in prison. The case was investigated by Immigration and Customs Enforcement. Assistant U.S. Attorney Scott Rask is prosecuting.

Oscar Garcia, 31, a citizen of Mexico, is charged with illegal re-entry on June 20, 2010, after being convicted of an aggravated felony and deported. If convicted Garcia faces a maximum of 20 years in prison. The case was investigated by Immigration and Customs Enforcement. Assistant U.S. Attorney David Smith is prosecuting.

Fabian Roman-Fernandez, 28, not a citizen of the United States, is charged with illegal re-entry on June 14, 2010, after being convicted of an aggravated felony and deported. If convicted Roman-Fernandez faces a maximum of 20 years in prison. The case was investigated by Immigration and Customs Enforcement. Assistant U.S. Attorney Randy Hendershot is prosecuting.

In all cases, defendants are presumed innocent until and unless proven guilty. The indictments filed merely contain allegations of criminal conduct.
