
ALIEN PLEADS GUILTY TO ILLEGAL RE-ENTRY
FAVIAN HERNANDEZ, age 31, a resident of Mexico, pled guilty in federal court yesterday before U. S. District Judge Kurt D. Engelhardt to a one-count indictment charging him with illegal re-entry by a removed alien, announced U. S. Attorney Jim Letten.
According to the factual basis, on approximately April 2, 2010, HERNANDEZ, an alien who had previously been removed, was found in Jefferson Parish, Louisiana without the proper consent. Additionally, HERNANDEZ was convicted on July 22, 2009 in Georgia for felony possession of cocaine.
Because of the prior felony conviction, HERNANDEZ faces a possible maximum penalty of ten (10) years imprisonment, a fine of $250,000, and three (3) years of supervised release following any term of imprisonment. Sentencing has been scheduled for September 22, 2010 at 9:00 A.M.
The case was investigated by the U. S. Immigration and Customs Enforcement. The case is being prosecuted by Special Assistant U. S. Attorney Robert Weir.
