FEDERAL GRAND JURY INDICTMENT OF A PREVIOUSLY CONVICTED FELON
MARCUS D. McKNIGHT, age 35, a resident of New Orleans, Louisiana, was charged in a one-count indictment by a Federal Grand Jury for possession of a firearm by a convicted felon, announced U. S. Attorney Jim Letten.
According to court documents, on or about June 10, 2010, McKNIGHT was in possession of a Marlin Firearms Company, Model 9, 9 mm rifle in the Eastern District of Louisiana.
McKNIGHT was previously convicted on or about July 13, 1995 in the Circuit Court for the City of Hampton, Virginia, for possession of cocaine and again on or about August 29, 2006, in the Superior Court of Hall County, Georgia, for two counts of selling cocaine. As such, McKNIGHT was prohibited by federal law from possessing a firearm.
If convicted, McKNIGHT faces a maximum term of imprisonment of ten (10) years, a maximum fine of the greater of $250,000 or twice the gross loss to any victim or twice the gross gain to the defendant, and up to three (3) years of supervised release following any term of imprisonment.
U. S. Attorney Letten reiterated that the indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.
The case was investigated by the New Orleans Police Department and the Bureau of Alcohol, Tobacco, Firearms & Explosives and is being prosecuted by Assistant U. S. Attorney Edward J. Rivera of the Violent Crime Unit.
