SEBANIA ICAL-ICAL, age 26, a citizen of Guatemala, was charged in a two-count indictment by a Federal Grand Jury for making a false statement in a passport application and for misuse of a social security number, announced U. S. Attorney Jim Letten.

According to court documents, on or about October 17, 2011, ICAL made false statements on a passport application, claiming that his name was Luis Miguel Lopez Rivera and that he was born in Puerto Rico. Also according to court documents ICAL falsely represented that a social security number was assigned to him, in order to obtain a U.S. passport, when in fact the social security number had not been assigned to him.

If convicted, ICAL faces on count one, a maximum term of imprisonment of ten years and on count two a maximum term of imprisonment of five years. As to both counts, ICAL faces a maximum fine of $250,000 and three years of supervised release following any term of imprisonment.

U. S. Attorney Letten reiterated that the indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.

The case was investigated by U.S. Immigration and Customs Enforcement, Homeland Security Investigations. The case is being prosecuted by Special Assistant U. S. Attorney Joe La Rocca.
