TEWKSBURY MAN CHARGED WITH FAILING TO REMIT EMPLOYMENT TAXES TO IRS

BOSTON, Mass. - A Tewksbury man was charged today in federal court with failing to pay over Internal Revenue Service employment and income taxes which he had withheld from his employees’ wages.

United States Attorney Carmen M. Ortiz and Susan M. Dukes, Special Agent in Charge of the Internal Revenue Service’s Criminal Investigation - Boston Field Office, announced today that SCOTT I. SUTHERLAND, 49, of Tewksbury, was charged in a one-count Indictment with willful failure to collect or pay over taxes.

The Indictment alleges that SUTHERLAND conducted a business in Tewksbury under the name Sutherland Installation and Service. During the second quarter of 2004, ending June 30, 2004, he allegedly deducted approximately $9,300 from his employees’ wages, for federal income taxes and Federal Insurance Contributions Act (FICA) taxes. It is alleged that he then failed to truthfully account for and pay over to the Internal Revenue Service the federal income taxes and FICA taxes that he withheld from his employees’ wages.

If convicted on these charges, SUTHERLAND faces up to five years imprisonment, to be followed by up to three years of supervised release and a $250,000 fine.

The case was investigated by the Internal Revenue Service. It is being prosecuted by Assistant U.S. Attorney Kristina E. Barclay of Ortiz’s Economic Crimes Unit.

The details contained in the Indictment are allegations. The defendant is presumed to be innocent unless and until proven guilty beyond a reasonable doubt in a court of law.
