BOSTON, Mass. - A Springfield man was convicted yesterday in federal court of Conspiracy, Unlawful Firearms Dealing, and five counts of Felon in Possession of Firearm.

JOSE ANDINO, 24, of Springfield, pleaded guilty before U.S. District Judge Michael A. Ponsor to Conspiracy, Unlawful Firearms Dealing, and Possession of a Firearm and Ammunition by a Convicted Felon. At the plea hearing, the prosecutor told the Court that had the case proceeded to trial the Government’s evidence would have proven that Andino sold 13 firearms and numerous rounds of ammunition between September and October 2009.

If convicted, Andino faces up to five years imprisonment on the conspiracy charge, five years of imprisonment on the unlawful dealing charge and 10 years of imprisonment on each of felon in possession charges. All carry a term of up to 3 years of supervised release and $250,000 fine. Judge Ponsor scheduled sentencing for February 1, 2011.

United States Attorney Carmen M. Ortiz, Eugenio A. Marquez, Acting Special Agent in Charge of the Bureau of Alcohol, Tobacco, Firearms and Explosives - Boston Field Division and Colonel Marian McGovern, Superintendent of the Massachusetts State Police made the announcement today. The case is being prosecuted by Assistant U.S. Attorney Alex J. Grant of Ortiz’s Springfield Branch.
