Baltimore Armed Career Criminal Exiled to 15 Years in Prison for Illegal Possession of a Firearm
Baltimore, Maryland - U.S. District Judge Andre M. Davis sentenced Delano Melvin Maith, age 28, of Baltimore, Maryland, today to 180 months in prison, followed by four years of supervised release for being a felon in possession of a firearm, announced United States Attorney for the District of Maryland Rod J. Rosenstein and Baltimore City State’s Attorney Patricia C. Jessamy. Judge Davis enhanced Maith’s sentence upon finding that he was an armed career criminal based on two convictions for possession with intent to distribute narcotics and one conviction for second degree assault.
According to information presented to the court at Maith’s plea, on June 12, 2007, Baltimore City 911 operators received a call for a domestic assault in which a man had pointed a gun at a woman’s face. Officers responded and saw a man, later identified as Maith, leaving the apartment building who matched the description they had been given. As officers exited their vehicles and approached, Maith grabbed his front waistband area and began to run. After a brief chase Maith was apprehended and a loaded .32 caliber Ceska Zbrojova was recovered from Maith’s front waistband. Officers went to the residence where the assault was reported and learned that Maith had come to see his girlfriend because he was upset with her for spending the night with her cousin. Maith and his girlfriend argued and Maith pointed the gun at her face. Her cousin advised Maith that they had called the police and he left the apartment, where the officers saw him.
United States Attorney Rod J. Rosenstein and Baltimore City State’s Attorney Patricia C. Jessamy thanked the Baltimore City Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives for their assistance in the investigation. Mr. Rosenstein and Ms. Jessamy commended Special Assistant United States Attorney Traci Robinson, a cross-designated Baltimore City Assistant State’s Attorney assigned to EXILE cases, who prosecuted the case and Assistant State’s Attorney Arcelia Greene, who assisted in the prosecution.
