Redby felon indicted for possessing a 12-gauge shotgun

MINNEAPOLIS—A federal indictment recently unsealed charges a 27-year-old Redby
man with being a felon in possession of a 12-gauge, sawed-off shotgun. The indictment, which
was filed on April 3, 2012, charges Timothy Clarence Stately with one count of being a felon in
possession of a firearm and one count of possession of an unregistered sawed-off shotgun. The
indictment was unsealed on April 12, 2012, following Stately’s initial appearance in federal
court.
The indictment alleges that between May 29 and 31, 2011, Stately possessed the gun, which
had an obliterated serial number. Because he is a felon, Stately is prohibited under federal law
from possessing firearms or ammunition at any time. He was previously convicted of seconddegree
assault with a dangerous weapon.
If convicted in the current federal case, Stately faces a potential maximum penalty of ten
years in prison on each charge. All sentences will be determined by a federal district court
judge.
This case is the result of an investigation by the Red Lake Tribal Police Department and the
United States Bureau of Alcohol, Tobacco, Firearms and Explosives. It is being prosecuted by
Assistant U.S. Attorney Jeffrey S. Paulsen.

An indictment is a determination by a grand jury that there is probable cause to believe that offenses have been committed by a defendant. A defendant, of course, is presumed innocent until he or she pleads guilty or is proven guilty at trial.
