Prosecutions continue in illegal entry cases involving those with prior criminal records

MINNEAPOLIS – Facundo Valdovinos-Magdaleno, age 35, has been charged with one
count of illegal re-entry into the United States following deportation. His indictment, which was
filed earlier today, alleges that on February 14, 2012, he was found in the U.S. after having
been previously deported, in 2000, following a prison sentence served for a federal court
conviction in the District of Minnesota for aiding and abetting the distribution of
methamphetamine. The current federal indictment resulted from his February 14 arrest by U.S.
Immigration and Customs Enforcement’s Enforcement and Removal Operations (“ICE ERO”)
in St. Paul.
If convicted of the federal charge now levied against him, Valdovinos-Magdaleno will
face a potential maximum penalty of 20 years in federal prison, followed by deportation. All
sentences will be determined by a federal district court judge. Until his current federal case is
resolved, Valdovinos-Magdaleno will remain in law enforcement custody.
This case is being prosecuted by Assistant U.S. Attorney Thomas Calhoun-Lopez.
An indictment is a determination by a grand jury that there is probable cause to believe that offenses have been committed by a defendant. A defendant, of course, is presumed innocent until he or she pleads guilty or is proven guilty at trial.
