SPRINGFIELD, Mo. – David M. Ketchmark, Acting United States Attorney for the Western District of Missouri, announced today that the owner of a Springfield, Mo., store has been indicted by a federal grand jury for selling counterfeit Nike shoes and Major League Baseball caps.

Edgar Hagens, 55, of Springfield, was charged in a two-count indictment returned by a federal grand jury in Springfield on Tuesday, Nov. 6, 2012. Hagens is the owner of Rock’s Dress Out Fashions, 413 N. Boonville, Springfield.

The federal indictment alleges that Hagens sold counterfeit Nike shoes on Aug. 20, 2012. The indictment also alleges that Hagens sold counterfeit Major League Baseball caps between Aug. 1 and 25, 2012.

The indictment also contains a forfeiture allegation, which would require Hagens to forfeit to the government any property used to commit the alleged offenses, including 14 counterfeit Major League Baseball caps, some of which were purchased by federal agents on Aug. 1, 2012, and some of which were seized by federal agents on Aug. 25, 2012, and a pair of counterfeit Nike shoes that were purchased by federal agents on Aug. 20, 2012.

Ketchmark cautioned that the charges contained in this indictment are simply accusations, and not evidence of guilt. Evidence supporting the charges must be presented to a federal trial jury, whose duty is to determine guilt or innocence.

This case was prosecuted by Assistant U.S. Attorney Patrick Carney. It was investigated by the Department of Homeland Security.
