Indianola Man Pleads Guilty
to Misuse of pesticides

OXFORD, Miss. – William C. Martin, Acting United States Attorney for the Northern District of Mississippi, announced that:

Thomas Mitchell Pitts, 53, of Indianola, Mississippi, pled guilty and was sentenced Monday before United States Magistrate Judge David A. Sanders, in Greenville, Mississippi, to a one-count Information charging him with misuse of a pesticide, in violation of 7 U.S.C. § 136j(2)(G).

Judge Sanders ordered Pitts to serve a term of six (6) months probation, to pay a $5,000 fine, and to pay restitution in the amount of $4,625. Pitts was ordered to pay two victims of his crime $2,000 each in restitution and to pay the State Crime Lab $625 in restitution.

The Information alleged that Mr. Pitts knowingly used a registered pesticide, Temik, in a manner inconsistent with its labeling. A copy of the Information is attached.

This case was investigated by the United States Environmental Protection Agency - Criminal Investigation Division, in cooperation with the U.S. Fish and Wildlife Service, the Mississippi Bureau of Plant Industry, and the Mississippi Department of Wildlife, Fisheries and Parks, and was prosecuted by Assistant United States Attorney Robert Mims.
