Informational: Federal Court Arraignments
Bill Mercer, United States Attorney for the District of Montana, announced today that during a federal court session in Missoula, on August 11, 2009, before U.S. District Judge Donald W. Molloy, the following individuals were arraigned:
DAVID COLTER WILES, a 26-year-old resident of Missoula, appeared on charges of receipt and possession of child pornography. He is currently detained. If convicted of these charges, WILES faces possible penalties of a mandatory minimum of 15 years in prison and could be sentenced to 40 years, a $250,000 fine and lifetime supervision. Assistant U.S. Attorney Cyndee L. Peterson is the prosecutor for the United States. The investigation was conducted by the Federal Bureau of Investigation.
WILLIAM VERNON WILLIAMS, a 36-year-old resident of Missoula, appeared on charges of receipt and possession of child pornography. He is currently detained. If convicted of these charges, WILLIAMS faces possible penalties of a mandatory minimum of 15 years in prison and could be sentenced to 40 years, a $250,000 fine and lifetime supervision. Assistant U.S. Attorney Cyndee L. Peterson is the prosecutor for the United States. The investigation was conducted by the Federal Bureau of Investigation.
BRIAN KLOBUCHAR, a 46-year-old resident of Stevensville, appeared on a charge of disposal of hazardous waste without a permit. He is currently detained. If convicted of this charge, KLOBUCHAR faces possible penalties of 5 years in prison, a $50,000 fine and 3 years supervised release. Assistant U.S. Attorney Tara J. Elliott is the prosecutor for the United States. The investigation was conducted by the U.S. Forest Service - Law Enforcement and Investigations Division.
The defendants pled not guilty to the charges.
The charge, an indictment, information or complaint, is merely an accusation and all persons named as defendants are presumed innocent until proven guilty. A pre-trial conference and a trial date will be set and the United States will be required to prove the allegations set forth in the indictment beyond a reasonable doubt.
