James David Cnockaert Found Guilty in U.S. Federal Court

Bill Mercer, United States Attorney for the District of Montana, announced today that on September 14, 2009, in Missoula, after a 1-day federal district court trial before U.S. District Judge Donald W. Molloy, JAMES DAVID CNOCKAERT, a 54-year-old resident of Virginia, was found guilty of receipt of child pornography. Sentencing is set for December 17, 2009. He is currently released on special conditions.

Assistant U.S. Attorneys Cyndee L. Peterson and Kris A. McLean prosecuted the case for the United States.

CNOCKAERT faces possible penalties of a mandatory minimum of 5 years in prison and could be sentenced to 20 years, a $250,000 fine and lifetime supervision.

The investigation was a cooperative effort between the Bozeman Police Department and the Federal Bureau of Investigation.
