
Kennedy Ann Kindness Pleads Guilty in U.S. Federal Court
The United States Attorney's Office announced that during a federal court session in Missoula on March 23, 2010, before U.S. Magistrate Judge Jeremiah C. Lynch, KENNEDY ANN KINDNESS, a 25-year-old resident of Helena, pled guilty to being a felon-in-possession of a firearm. Sentencing has been set for July 1, 2010. She is currently detained.
In an Offer of Proof filed by Assistant U.S. Attorney Tara J. Elliott, the government stated it would have proved at trial the following:
On September 6, 2006, KINDNESS was convicted of deceptive practices which thereby prohibited her from possessing firearms.
On February 23, 2009, KINDNESS, along with another individual, fired and used a firearm, that is, a Hi-Point 9mm pistol near Helena.
KINDNESS faces possible penalties of 10 years in prison, a $250,000 fine and 3 years supervised release.
The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives.
