The United States Attorney's Office announced that during a federal court session in Missoula on May 3, 2010, before U.S. Magistrate Judge Jeremiah C. Lynch, DAVID JOHN ROBERTS, a 42-year-old resident of Missoula, pled guilty to possession of a firearm and ammunition after having been convicted of misdemeanor domestic violence. Sentencing has been set for September 8, 2010. He is currently released on special conditions.

In an Offer of Proof filed by Assistant U.S. Attorney Tara J. Elliott, the government stated it would have proved at trial the following:

On June 6, 2005, ROBERTS was convicted of a misdemeanor crime of domestic violence in the state of Oregon.

On January 14, 2008, ROBERTS admitted to being in possession of firearms. A search warrant of his home was conducted and a pistol was recovered in his bedroom along with a large amount of ammunition. Additionally, he admitted he had stored numerous rifles at his father's home.

ROBERTS faces possible penalties of 10 years in prison, a $250,000 fine and at least 3 years supervised release.

The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives.
