Informational: Federal Court Arraignments
The United States Attorney's Office announced that during a federal court session in Billings, on August 30, 2010, before U.S. Magistrate Judge Carolyn S. Ostby, the following individuals were arraigned:
PAULA HUEBNER, a 39-year-old resident of Billings, appeared on charges of conspiracy to possess with the intent to distribute cocaine and distribution of cocaine. She is currently released on special conditions. If convicted of these charges, HUEBNER faces possible penalties of 20 years in prison, a $1,000,000 fine and 3 years supervised release. Assistant U.S. Attorney James E. Seykora is the prosecutor for the United States. The investigation was a cooperative effort between the Federal Bureau of Investigation, the Drug Enforcement Administration, the High Intensity Drug Trafficking Area (HIDTA) Task Force, U.S. Homeland Security Investigations, the U.S. Marshals Service, the Billings Police Department, the Yellowstone County Sheriff's Office and Montana Division of Criminal Investigation.
JEROME DANIEL MANCUSO, a 42-year-old resident of Billings, appeared on charges of possession with the intent to distribute cocaine, distribute of cocaine, maintaining drug-involved premises and use of communication facility. He is currently detained. If convicted of these charges, MANCUSO faces possible penalties of mandatory minimum of 5 years in prison and could be sentenced to 40 years, a $2,000,000 fine and at least 4 years supervised release. The investigation was a cooperative effort between the Federal Bureau of Investigation, the Drug Enforcement Administration, the High Intensity Drug Trafficking Area (HIDTA) Task Force, U.S. Homeland Security Investigations, the U.S. Marshals Service, the Billings Police Department, the Yellowstone County Sheriff's Office and Montana Division of Criminal Investigation.
JAMES DARIN MARKER, a 37-year-old resident of Billings, appeared on a charge of possession with the intent to distribute cocaine. He is currently detained. If convicted of this charge, MARKER faces possible penalties of 20 years in prison, a $1,000,000 fine and 3 years supervised release. Assistant U.S. Attorney James E. The investigation was a cooperative effort between the Federal Bureau of Investigation, the Drug Enforcement Administration, the High Intensity Drug Trafficking Area (HIDTA) Task Force, U.S. Homeland Security Investigations, the U.S. Marshals Service, the Billings Police Department, the Yellowstone County Sheriff's Office and Montana Division of Criminal Investigation.
The defendants pled not guilty to the charges.
The charge, an indictment, information or complaint, is merely an accusation and all persons named as defendants are presumed innocent until proven guilty. A pre-trial conference and a trial date will be set and the United States will be required to prove the allegations set forth in the indictment beyond a reasonable doubt.
