
Timothy Reynolds Pleads Guilty in U.S. Federal Court
The United States Attorney's Office announced that during a federal court session in Missoula, on November 3, 2010, before U.S. District Judge Donald W. Molloy, TIMOTHY REYNOLDS, a 44-year-old resident of Layton, Utah, pled guilty to conspiracy to distribute methamphetamine. Sentencing has been set for February 17, 2011. He is currently detained.
In an Offer of Proof filed by Assistant U.S. Attorney Tara J. Elliott, the government stated it would have proved at trial the following:
On October 5, 2009, the Montana Highway Patrol conducted a traffic stop on the vehicle REYNOLDS was driving. Based on information received from a confidential informant, it was believed REYNOLDS was driving from Ogden, Utah, to Ravalli County to deliver methamphetamine to another person. REYNOLDS refused the Trooper's consent to search the vehicle so within a few minutes, a Drug Enforcement Administration agent arrived and placed REYNOLDS under arrest for conspiracy to distribute methamphetamine.
During a search of the vehicle, four plastic zip-lock bags containing 17.2 net total grams of methamphetamine were discovered in a bag located in the front passenger seat area of the vehicle where R.W. had been sitting. R.W. stated the pack belonged to both R.W. and REYNOLDS and that it might contain some contraband. During a continued search of the vehicle, a plastic zip-lock bag containing 82.3 net grams of methamphetamine was found inside a portable vacuum in the rear cargo area of the vehicle.
In a search incident to REYNOLD's arrest, one plastic cigarette pack wrapper and one small plastic zip-lock baggie, each of which contained .16 net grams of methamphetamine was recovered. The total amount of methamphetamine seized as a result of the stop resulted in well over 50 grams of actual methamphetamine.
When interviewed, REYNOLDS admitted that he started selling methamphetamine to K.M. around August of 2009. REYNOLDS further admitted that he sold on average 1/4 ounce to 1/2 ounce quantities of methamphetamine at a time to K.M. on a weekly basis, and on occasion several times a week. REYNOLDS estimated he had sold 1/2 ounce quantities to K.M. about four to five times and the rest of the times were 1/4 ounce quantities.
REYNOLDS faces possible penalties of a mandatory minimum of 10 years in prison and could be sentenced to life, a $4,000,000 fine and at least 5 years supervised release.
The investigation was conducted by the Drug Enforcement Administration.
