The United States Attorney's Office announced that during a federal court session in Billings, on January 12, 2011, before U.S. Magistrate Judge Carolyn S. Ostby, the following individuals were arraigned:

PABLO JOSEPH GONZALES, IV, a 22-year-old resident of Billings, and JEREMIAH RAY CUTSINGER, a 20-year-old resident of Ballantine, appeared on charges of theft of government monies. CUTSINGER is currently detained and GONZALES is currently released on special conditions. If convicted of these charges, they each face possible penalties of 1 year in prison, a $100,000 fine and 1 years supervised release. Assistant U.S. Attorney Jessica T. Fehr is the prosecutor for the United States. The investigation was conducted by the Law Enforcement and Investigations Division of the U.S. Forest Service.

SUSAN ROSE RAE, a 41-year-old resident of Roundup, appeared on charges of bank fraud and aggravated identity theft. She is currently released on special conditions. If convicted of these charges, RAE faces possible penalties of 30 years in prison, a $1,000,000 fine and 5 years supervised release. In addition, RAE faces an additional mandatory two year imprisonment, consecutive to any other sentence, for aggravated identity theft. Assistant U.S. Attorney Carl E. Rostad is the prosecutor for the United States. The investigation was conducted by the Federal Bureau of Investigation.

The defendants pled not guilty to the charges.

The charge, an indictment, information or complaint, is merely an accusation and all persons named as defendants are presumed innocent until proven guilty. A pre-trial conference and a trial date will be set and the United States will be required to prove the allegations set forth in the indictment beyond a reasonable doubt.
