The United States Attorney's Office announced that during a federal court session in Missoula, on February 17, 2011, before U.S. District Judge Donald W. Molloy, DONALD WEISWEAVER, a 31-year-old resident of Hamilton, appeared for sentencing. WEISWEAVER was sentenced to a term of:

Prison: 63 months

Special Assessment: $100

Supervised Release: 5 years

WEISWEAVER was sentenced in connection with his guilty plea to conspiracy to distribute methamphetamine.

In an Offer of Proof filed by Assistant U.S. Attorney Tara J. Elliott, the government stated it would have proved at trial the following:

On May 8, 2009, WEISWEAVER had a package containing approximately one ounce of methamphetamine delivered to S.S.'s home in Ravalli County. The package was sent from WEISWEAVER's mother who resides in Bakersfield, California. The shipment was intercepted by state and federal law enforcement officers and a controlled delivery took place at S.S.'s residence. After a series of law enforcement monitored text messages, WEISWEAVER arrived at S.S.'s to pick up said package and was apprehended. The contents of the package were analyzed and contained more than five grams of actual methamphetamine.

Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that WEISWEAVER will likely serve all of the time imposed by the court. In the federal system, WEISWEAVER does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.
