The United States Attorney's Office announced that during a federal court session in Billings, on March 30, 2011, before Senior U.S. District Judge Jack D. Shanstrom, CLIFF WILLIAM JOHN YOUPEE, a 23-year-old resident of Great Falls, appeared for sentencing. YOUPEE was sentenced to a term of:

Prison: 8 months

Special Assessment: $100

Supervised Release: 3 years

YOUPEE was sentenced in connection with his guilty plea to escape.

In an Offer of Proof filed by Assistant U.S. Attorney Jessica T. Fehr, the government stated it would have proved at trial the following:

On September 20, 2007, YOUPEE was sentenced to a fifty-one month prison sentence after having been convicted of assault resulting in serious bodily injury.

On July 14, 2010, YOUPEE was transferred by the Bureau of Prisons to the Alpha House in Billings. YOUPEE's expected release date was December 7, 2010.

On July 30, 2010, YOUPEE signed out of the Alpha House for the purpose of looking for employment. YOUPEE was scheduled to return to the Alpha House by 5:00 p.m. the same day. YOUPEE failed to return to the facility. YOUPEE's failure to return was verified by a search of the Alpha House and contact with local law enforcement and area hospitals.

YOUPEE was arrested in White Rocks, Utah, on September 20, 2010.

Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that YOUPEE will likely serve all of the time imposed by the court. In the federal system, YOUPEE does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.
