The United States Attorney's Office announced that during a federal court session in Missoula, on July 19, 2011, before U.S. District Judge Donald W. Molloy, PATRICK CHARLES NIMOCKS, a 36-year-old resident of Pitzville, appeared for sentencing. NIMOCKS was sentenced to a term of:

Prison: 120 months

Special Assessment: $100

Supervised Release: life

NIMOCKS was sentenced in connection with his guilty plea to viewing child pornography.

In an Offer of Proof filed by Assistant U.S. Attorney Cyndee L. Peterson, the government stated it would have proved at trial the following:

NIMOCKS was investigated by the Missoula County Sheriff's Office for the sexual assault of multiple male children. During the investigation, his residence was searched and a laptop was seized. NIMOCKS consented to the search of the laptop. Investigators determined that NIMOCKS and his girlfriend rented the laptop on August 20, 2009, from a business in Missoula.

A forensic examination of the laptop located graphics depicting child pornography. Those graphics were created between August 31, 2009, and October 22, 2009. Most of the graphics were located in Internet cache. The examiner also found relevant web browsing activity (Google searches): young naked little boys; very young naked boy; and gay little boy pic. The browsing activity was dated between August 30, 2009, through October 22, 2009. Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that NIMOCKS will likely serve all of the time imposed by the court. In the federal system, NIMOCKS does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.

The investigation was a cooperative effort between the Missoula County Sheriff's Office, the Montana Division of Criminal Investigation, and the Montana Internet Crimes Against Children (ICAC) Task Force.
